Napolitano says if NYT report is accurate, Trump may be implicated in attempted obstruction

Fox News judicial analyst Judge Andrew Napolitano on Tuesday considered a New York Times report that claimed President Trump tried to interfere in an investigation into his former personal attorney Michael Cohen, and the analyst said if the report is accurate Trump could be implicated in attempted obstruction.

The New York Times report claims that Trump called Acting Attorney General Matthew Whitaker last year to ask if Geoffrey S. Berman, the United States attorney for the Southern District of New York and a Trump ally, could be put in charge of the investigation into Cohen.

President Donald Trump’s former lawyer Michael Cohen will testify in a public hearing before a U.S. congressional committee on Feb. 27 and the panel’s chairman said Trump’s business practices would be a focus of the testimony.

The Oversight Committee said in a memo to its members that Cohen would be questioned about Trump’s “debts and payments relating to efforts to influence the 2016 election,” Trump’s compliance with tax and campaign finance laws, and Trump’s business practices, among other topics. Davis confirmed in a tweet that Cohen would appear before the Oversight Committee and said Cohen “will speak about his decade long experiences working for Mr. Trump.”

Judge Nap: New Report Could Show Evidence of 'Corrupt Intent' by Trump in Cohen Probe

Judge Andrew Napolitano reacted to a New York Times report alleging that President Trump called then-Acting Attorney General Matthew Whitaker and asked him to install a new prosecutor on the Michael Cohen case.

Napolitano said if such a phone call took place, it would amount to evidence of "corrupt intent" by the president to try to hinder the investigation. The report said Trump asked Whitaker to put Geoff Berman, the U.S. Attorney for the Southern District of New York, in charge of the case involving himself, Michael Cohen and National Enquirer chief David Pecker.

Trump, Giuliani deny president tried obstructing Michael Cohen investigation

President Trump's attorney, Rudolph Giuliani, denied a New York Times report that Trump asked then-Acting Attorney General Matt Whitaker whether U.S. Attorney Geoffrey Berman, a presidential ally, could be put in charge of the investigation into alleged wrongdoing by Trump's onetime personal attorney Michael Cohen.

In November, Cohen pleaded guilty to lying under oath to the Senate Intelligence Committee as part of Special Counsel Robert Mueller’s ongoing investigation into alleged collusion between the Trump campaign and Russian officials.
